# Terms and conditions of service

These Terms are issued by HostCupid Web Solutions Private Limited, trading as HostCupid ("HostCupid", "we", "us" or "our"). They govern website, hosting, support and related services supplied by HostCupid. The accepted quotation, invoice, order form and service-specific terms remain part of the agreement.

## 1. Agreement and order of documents

By ordering, paying for, activating or using a HostCupid service, the customer accepts these terms, the applicable quotation or order, invoice, plan description, Refund Policy, Privacy Policy and Acceptable Use Policy. A service-specific term accepted in writing takes priority for that service if it clearly conflicts with this general page.

Marketing pages describe typical services. They do not create an obligation to supply a feature, capacity, timeline or outcome unless it appears in the accepted order.

## 2. Account authority and accurate information

The person placing an order confirms that they are legally able to contract and, when acting for a business or another person, have authority to bind that customer. Customer and billing information must remain accurate. HostCupid may request reasonable identity, ownership, payment or authority verification before activating, changing or transferring a service.

## 3. Scope, exclusions and change requests

The written order defines deliverables, exclusions, assumptions, customer inputs, payment stages and responsibility. Work outside that scope—including extra pages, features, integrations, content, migration, repair or urgent support—requires written approval and may change the fee and timeline.

Advice, estimates or informal messages before an order are not final commitments unless incorporated into the accepted written scope.

## 4. Prices, taxes, payment and renewal

Prices are shown in the applicable order or invoice. Taxes, third-party charges, currency conversion and payment costs are handled as stated at purchase and under applicable law. Payment is due by the invoice date. HostCupid may pause work, withhold delivery, restrict access or suspend services when an undisputed amount remains overdue.

Recurring services renew according to the billing cycle shown in the order, invoice or client-area settings. The customer must review renewal invoices and cancel unwanted renewals before the new service period begins. Renewal prices may differ from promotional or first-term prices.

## 5. Customer content, access and approvals

The customer must provide accurate requirements, lawful content, licences, brand assets, access credentials, decisions and approvals within a reasonable time. The customer is responsible for confirming that submitted names, media, claims, products, personal data and instructions do not violate law or third-party rights.

HostCupid is not responsible for delay, additional work or loss caused by incomplete information, late approval, expired access, third-party restrictions or customer changes. Sensitive credentials should be shared only through an approved secure method and changed after handover where appropriate.

## 6. Project delivery, review and acceptance

Timelines are estimates unless the order expressly states a binding deadline. Delivery depends on timely content, access, approvals, payment, third-party availability and the absence of newly discovered technical conditions.

The customer must review each submitted stage within the review period in the quotation or, if none is stated, within a reasonable time. HostCupid will correct reproducible material defects that fall within the accepted scope. New preferences, additional functionality and changes to previously approved work are change requests.

A stage is treated as accepted when the customer approves it, uses it in production, instructs HostCupid to proceed to the next stage, or does not report a material in-scope issue within the agreed review period.

## 7. Hosting availability, maintenance and fair use

Hosting is a shared or managed technical service subject to published account limits, fair use, maintenance, network conditions, software compatibility and the Acceptable Use Policy. No internet service can be guaranteed to remain uninterrupted or error-free. Any service-level commitment applies only when stated in a separate written SLA.

HostCupid may perform emergency or planned maintenance, apply protective restrictions, move an account within its infrastructure, or require an upgrade when usage threatens stability, security or other customers. “Unlimited” features remain subject to CPU, memory, process, inode, mail, security and suitable-workload limits.

## 8. Domains, licences and third-party services

Domains, certificates, themes, plugins, gateways, SaaS products, APIs, advertising platforms and other third-party services remain subject to supplier availability, licence terms, pricing and policies. HostCupid cannot guarantee third-party approval, uptime, compatibility, continued functionality or reversal of a completed supplier purchase.

The customer must confirm the registrant, administrator, renewal and ownership details for domains and external accounts. Unless the written order states otherwise, third-party charges are separate and may be non-refundable.

## 9. Email, messaging and deliverability

HostCupid hosting and website plans do not include mailboxes hosted on HostCupid servers. Where Zoho’s free custom-domain plan is available and the customer is eligible, HostCupid may assist at no setup charge with connecting one domain and up to five Zoho Mail users. Zoho controls account eligibility, storage, sending limits, client-access features, availability and service terms. Bulk marketing and high-volume transactional email require a separate approved service, and inbox delivery cannot be guaranteed.

## 10. Backups, restoration and customer data

The customer must keep independent copies of important website, business and email data. Where a plan includes backups, they are an additional recovery measure—not the customer's only copy and not a guarantee that every file, message, database or restore point will be available or usable.

Restoration, retention and export depend on the plan and written scope. Before cancellation, migration or expiry, the customer must obtain required backups and verify them. After termination or expiry, data may be deleted without further recovery obligation, subject to applicable law and any written retention commitment.

## 11. Security and incident response

The customer is responsible for authorised users, strong credentials, multi-factor authentication where available, software maintenance and prompt reporting of suspected compromise. HostCupid may isolate, disable or remove malicious components when reasonably required to protect systems and users.

Security review, malware cleanup, forensic investigation and guaranteed recovery are not included in ordinary hosting unless expressly stated. No provider can promise complete prevention of attack or loss.

## 12. Support and communications

Support covers the channels, hours and responsibilities stated for the service. General hosting support does not automatically include website development, content changes, debugging third-party code, SEO, malware recovery or training. Response targets are not guaranteed unless included in a written SLA.

Hosting notices may be sent through the hosting client area, ticket system or invoice email. Website-project communication uses the contact details and channel agreed for that project. The customer must monitor the applicable channels and keep them current.

## 13. Suspension, restriction and termination

HostCupid may restrict, suspend or terminate a service for non-payment, abuse, illegal use, security risk, excessive resource use, false information, chargeback, failure to cooperate with an incident, or material breach. Immediate action may be taken when delay could harm customers, infrastructure, reputation or legal compliance.

Where reasonably possible and safe, HostCupid may provide an opportunity to correct the issue. Suspension does not remove amounts already due. Reactivation, investigation, cleanup, data export or migration may require separate payment.

## 14. Cancellation and refunds

Cancellation stops future service according to the applicable billing cycle; it does not automatically reverse completed work or a service period already supplied. Eligible first-time purchases may use the 7-calendar-day refund request window described in the [Refund Policy](/refund-policy.html). Domain, licence, supplier, consumed-resource and completed-work exclusions apply.

## 15. Intellectual property and licences

Customer-provided material remains the customer's responsibility. Ownership or licence of custom deliverables is determined by the written agreement and full payment. Unless transferred in writing, HostCupid retains its pre-existing tools, know-how, reusable components, processes and general technical methods.

Third-party software, fonts, themes, media, libraries and services retain their original licences. The customer must maintain any licence required after handover.

## 16. Confidentiality and privacy

Each party should protect non-public business and technical information received for the service and use it only for the agreed purpose, support, legal compliance or protection of rights. Personal information is handled under the [Privacy Policy](/privacy.html) and applicable law.

## 17. Warranties and outcome limitations

HostCupid will perform agreed professional work with reasonable care and skill. Except for an express written commitment or a right that cannot legally be excluded, services are supplied on an “as available” basis. HostCupid does not guarantee rankings, AI citations, enquiries, sales, revenue, uninterrupted third-party services, recovery of unavailable backups, perfect security or compatibility with every future software change.

## 18. Limitation of liability

To the maximum extent permitted by law, HostCupid is not liable for indirect, incidental, special or consequential loss, loss of profit, anticipated savings, reputation, business opportunity or data arising from circumstances outside its reasonable control, customer action or third-party services.

For an affected recurring service, HostCupid's aggregate contractual liability is limited to the fees paid for that service during the three months immediately preceding the event. For a one-time project, it is limited to the amount paid for the affected deliverable. These limits do not apply where liability cannot lawfully be limited, including applicable consumer rights, fraud or wilful misconduct.

## 19. Customer indemnity

To the extent permitted by law, the customer will protect HostCupid against third-party claims, reasonable costs and losses caused by customer content, unlawful instructions, infringement, unauthorised account use, resale activity or breach of these terms, except to the extent caused by HostCupid's own unlawful conduct.

## 20. Events outside reasonable control

Neither party is responsible for delay caused by events beyond reasonable control, including internet or power failure, natural disaster, war, civil disturbance, government action, supplier outage, labour disruption or widespread cyberattack. Payment for services already delivered remains due.

## 21. Changes to services or terms

HostCupid may update these general terms for legal, security, operational or product reasons. Material changes apply prospectively and will be published with a revised effective date or otherwise communicated where required. A service-specific accepted agreement is not changed retrospectively unless both parties agree or law requires it.

## 22. Grievances, governing law and disputes

Questions or complaints should first be sent to the Grievance Officer at info@hostcupid.com with the account, invoice and issue details. HostCupid will acknowledge a consumer grievance within 48 hours and aim to resolve it within one month, subject to complexity and applicable law.

These terms are governed by Indian law. Courts at Chennai, Tamil Nadu will have jurisdiction for business disputes, subject to any mandatory consumer forum, territorial jurisdiction or statutory remedy that cannot be excluded. The parties should first attempt a good-faith written resolution.
